Signing the final settlement as «no conforme» (not agreed)

Before you sign the final settlement (finiquito), you can compare what you are being offered with the legal minimum, item by item. Choose how your contract ended and type in the figures from the proposal.

How do you want to start?

You can upload the documents your employer has given you to fill in the details with what is read from them, or type them in yourself. Before anything is calculated, you review each detail.

What signing «no conforme» means

What it means

When the contract ends, the employer gives you a proposed settlement statement (documento de liquidación) with the amounts due to you (art. 49.2 ET). Some people, when they do not agree with an amount, sign it adding «recibí no conforme» (received, not agreed) or «no conforme» (not agreed).

That note does not change what the employer pays you: it puts in writing that you do not agree with some figure. We give this only as information. What to do in your case can be assessed by an employment law firm, a graduado social (labour relations adviser) office or a trade union.

With someone from the workforce present

You can ask for a workers’ legal representative to be present when you go to sign the final settlement (finiquito). The document records whether you sign it in their presence or have not used that option (art. 49.2 ET).

Example: comparing before signing

A person earning 1.500 € gross a month with two extra payments of 1.500 € resigns on 15 October 2026, having worked since 1 March 2023. They have taken 10 of their 22 working days of holiday and have given the 15 days’ notice set by their collective agreement. The proposal pays them 300,00 € for holiday.

Holiday The legal minimum comes to between 501,74 € and 581,88 €, depending on whether it is counted by days or by months. At least 201,74 € is missing compared with 300,00 €.

The calculator does the same with each item: enter what the proposal says on the “Your final settlement” sheet and you will see what matches the legal minimum and what does not.

The time limits keep running

For outstanding pay, holiday, extra payments or severance pay at the end of a fixed-term contract, the time limit is one year (art. 59.1 ET).

In a dismissal, the time limit to challenge it is 20 business days (días hábiles) (art. 59.3 ET). That time limit is interrupted when you file the request for conciliation with the relevant public mediation, arbitration and conciliation service. It is short, and an employment law firm, a graduado social (labour relations adviser) office or a trade union can tell you which one applies to your case.

Frequently asked questions

What happens if I sign the final settlement as «no conforme»?

Adding «recibí no conforme» (received, not agreed) or «no conforme» (not agreed) does not change what the employer pays you: it puts in writing that you do not agree with some amount. We give this only as information: what to do in your case can be assessed by an employment law firm, a graduado social (labour relations adviser) office or a trade union.

Do I have to sign the final settlement?

Art. 49.2 ET does not say that you have to sign it. What it regulates is that the employer hands over a proposed settlement statement (documento de liquidación) with what it owes and that you can ask for someone from the workers' legal representatives to be present when you sign.

Can I ask for someone from the workforce to be present?

Yes. The worker can ask for a workers' legal representative to be present when signing the final settlement, and if they do not ask, the document records this (art. 49.2 ET).

What is the time limit if an amount does not add up?

For outstanding pay, holiday, extra payments or severance pay at the end of a fixed-term contract, one year (art. 59.1 ET). For a dismissal, the time limit to challenge it is 20 business days (días hábiles) (art. 59.3 ET).
